B2 Hookah™ Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "User," or "you") and B2 Hookah™ ("Company," "we," "us," or "our"), governing your access to and use of www.b2hookah.com (the "Site") and any orders placed through it. By using this Site or completing a purchase, you agree to be bound by these Terms, our Privacy Policy, and our Shipping & Returns Policy.

1. Age Requirement & Mandatory Identity Verification

Federal and state regulations prohibit the sale of tobacco, nicotine, and smoking hardware to individuals under 21 years of age. By placing an order, you confirm that you are at least 21 years old and purchasing solely for personal use.

• Automated Screening: Every order undergoes real-time age verification through certified third-party software (e.g., BlueCheck or AgeChecker.net). Your billing name, address, and date of birth are cross-referenced against public and government records.
• Photo Identification Requests: If automated verification fails or produces partial matches, B2 Hookah™ reserves the unconditional right to request a clear, government-issued photo ID prior to order fulfillment. Orders not verified within five (5) business days will be cancelled and refunded less payment gateway processing charges.
• Fraudulent Submissions: Placing an order using another individual's identity or payment details is a federal offense. We aggressively report all identity-spoofing and underage purchase attempts to local law enforcement and federal agencies.

2. Orders, Acceptance & Unilateral Cancellation Rights

Your order receipt or email confirmation is an acknowledgment that we received your purchase request; it does not constitute final acceptance of your offer to purchase. A legally binding contract is formed only when your order has been physically packed and dispatched with a carrier tracking number.

B2 Hookah™ reserves the right to refuse, limit, or cancel any order at our sole discretion at any time prior to shipment, without liability, for reasons including but not limited to:

• Inability to verify legal age or cardholder identity;
• Pricing errors, typographic mistakes, or inaccurate stock inventory;
• Suspected fraudulent payment, stolen card metrics, or billing-shipping address mismatches;
• Quantities or purchasing patterns indicating commercial resale, drop-shipping, or automated bot purchases;
• Shipping destinations where local, state, or international laws prohibit the import of hookahs, tobacco, or related accessories.

3. Pricing, Payments & Merchant Restrictions

All prices displayed on the Site are in United States Dollars ($USD) and exclude shipping fees, sales taxes, and customs duties, which are calculated and itemized at checkout.

• Authorized Payment Methods: We accept Visa, MasterCard, Discover, American Express, and authorized bank wire transfers. Because major digital wallet providers (such as Apple Pay, Google Pay, and PayPal) maintain strict restrictions prohibiting online tobacco and smoking pipe transactions, these payment methods are generally disabled at checkout.
• Pre-Authorization & Settlement: Your payment method is authorized and charged upon checkout. If funds do not clear or your banking institution flags the transaction, the order will be placed on administrative hold immediately.
• Taxes & Compliance: You are solely responsible for all state and local excise taxes, sales taxes, and compliance requirements applicable in your jurisdiction.

4. Shipping, Delivery & Carrier Risk Transfer

B2 Hookah™ packages and dispatches orders via USPS, UPS, FedEx, or DHL according to carrier efficiency and logistics schedules.

• Proof of Delivery & Risk of Loss: Once an order is transferred to the carrier, the risk of loss passes to the buyer. Delivery is legally complete when the carrier’s tracking log records the package as "Delivered" (including GPS scan coordinates). B2 Hookah™ is not responsible or liable for packages stolen from doorsteps, mailrooms, porches, or front desks post-delivery ("porch piracy").
• Carrier Claims & Coverage Limits: Standard carrier liability is strictly capped at $100 unless the Customer selected and paid for third-party shipping insurance (such as Route or OrderProtection) at checkout. B2 Hookah™ will assist in filing claims for packages lost in transit before delivery, but refunds or replacements are limited strictly to the sum recovered from the carrier.
• Adult Signature Delivery: Orders exceeding $150 in value, restricted tobacco items, or high-value hardware require an Adult Signature (21+) upon delivery. If an order is returned to us after multiple failed delivery attempts, the customer is responsible for both original outbound and return shipping costs, plus a 15% restocking fee.

5. Returns, Refunds & Restocking Terms

All sales are considered final unless explicitly authorized under our return guidelines:

• Return Authorization (RMA): Customers must contact sales@b2hookah.com within fourteen (14) days of delivery to request a Return Merchandise Authorization (RMA). Unauthorized returns will be rejected at the warehouse.
• Condition Requirements: Returned items must be brand-new, completely unused, in their original retail packaging, and include all manuals, accessories, and promotional extras.
• Restocking & Shipping Deductions: Approved returns for customer preference or remorse are subject to a mandatory 15% restocking fee. Outbound shipping costs are strictly non-refundable, and return shipping is the customer's responsibility using a fully tracked, insured carrier.
• Non-Returnable Items:
  • Opened, unsealed, or handled tobacco, shisha, or herbal molasses;
  • Hoses, mouthpieces, grommets, or bowls that have been used or washed;
  • Mystery boxes, archive one-off bundles, and discounted clearance items;
  • Custom-machined, customized resin, or 1-of-1 Precious Cut Collection™ builds.

6. Precious Cut Collection™, Artisan Woods & Normal Wear Disclaimer

Hookahs, heat management devices, clay bowls, and leather accessories are functional smoking apparatuses exposed to direct flame, extreme thermal expansion, moisture, and chemical residues every session. Physical changes resulting from normal usage do not constitute defects.

• Artisan Materials & Handcrafted Variations: Items in our Precious Cut Collection™ feature hand-lathed stabilized burl wood, custom-poured epoxy resins, and anodized aluminum. Natural timber checking, grain figuring, resin air pockets, color swirls, and traces of polishing compounds are inherent characteristics of hand-lathed artisan goods and are not grounds for a defective return or chargeback.
• Wear and Tear Is Not a Defect: We specifically disclaim warranty and defect coverage for:
  • Heat discoloration, scorched finishes, or carbon deposits on metal trays, stems, and heat management systems;
  • Tarnishing or natural patina on unlacquered brass, copper, or anodized finishes;
  • Micro-fractures, crazing, or molasses bleed in clay or stoneware bowls;
  • Natural wood grain expansion or finish wear caused by water exposure or humidity shifts;
  • O-ring, silicone grommet, or ball valve degradation over time.
• Care & Misuse: Never submerge wooden sleeves in standing water. Do not wash high-end anodized parts or crystal vases in a household dishwasher. Damage caused by aggressive cleaning chemicals, drops, cross-threading, or overtightening voids all service claims.

7. Damaged, Defective, or Incorrect Deliveries

If your package arrives physically damaged or missing components, you must notify B2 Hookah™ at sales@b2hookah.com within 48 hours of carrier delivery. You must retain all original shipping cartons, interior packing peanuts/bubble wrap, broken components, and shipping labels. High-resolution photographs showing both the outer shipping box damage and the broken merchandise are mandatory to support carrier claims. Failure to retain materials or notify us within 48 hours constitutes full acceptance of the merchandise as delivered.

8. Payment Disputes, Fraud Prevention & Chargebacks

Initiating a payment dispute or card chargeback without prior communication with B2 Hookah™ is a material breach of these Terms. By submitting an order, you expressly agree to contact our support desk first to resolve any billing, fulfillment, or warranty inquiry.

• Administrative Dispute Fee: In the event of a fraudulent, improper, or frivolous chargeback (including claiming "Item Not Received" despite a valid carrier GPS delivery scan, or initiating a return chargeback for normal wear/artisan wood characteristics), you agree to pay B2 Hookah™ a $50.00 administrative fee to cover merchant processing dispute penalties and internal processing overhead.
• Collections & Credit Bureau Reporting: All unresolved chargebacks will be transferred to a licensed third-party debt collection agency and reported as delinquent accounts to national credit bureaus (Equifax, Experian, TransUnion). The Customer agrees to pay all collection agency commissions (up to 40%), attorney fees, and litigation costs incurred during debt recovery.

9. International Orders & Customs Compliance

International shipments are handled via DHL, UPS, or USPS. By placing an international order, the Customer assumes complete responsibility for cross-border regulatory compliance:

• Import Duties & Taxes: All import duties, VAT, excise taxes, clearing tariffs, and processing fees are levied by the destination country and must be paid by the Customer. We do not falsify customs declarations or mislabel goods as "gifts."
• Customs Seizures & Abandonment: Many jurisdictions strictly prohibit the import of tobacco, shisha, or e-hookah devices. If an international package is held, seized, destroyed, or confiscated by customs authorities, no refunds or replacements will be provided under any circumstances.
• Refused Shipments: If a package is rejected by the recipient or returned due to unpaid duties, the return freight cost, carrier brokerage fees, and a 15% restocking fee will be deducted from any eligible merchandise refund. Original shipping fees are strictly non-refundable.

10. Intellectual Property Rights

All content on B2Hookah.com—including registered trademarks, logos, patents, industrial CAD models, product silhouettes (e.g., B2 V5, F-22, Precious Cut Collection™), text, photography, and code—is the proprietary property of B2 Hookah™. No portion of this Site may be reproduced, reverse-engineered, scraped, or republished for commercial purposes without prior written authorization.

11. Health Warnings & Assumption of Risk

Hookah pipes, shisha tobaccos, natural charcoals, and electronic heating heads are intended strictly for adult recreational use. By purchasing, you acknowledge the inherent health risks associated with inhalation, combustion, and high-heat equipment:

• U.S. SURGEON GENERAL’S WARNING: Tobacco use increases the risk of lung cancer, heart disease, emphysema, and complications during pregnancy.
• California Proposition 65 Warning: ⚠ WARNING: This product contains chemicals, including nicotine and carbon monoxide, known to the State of California to cause cancer, birth defects, or other reproductive harm. For more information, visit www.P65Warnings.ca.gov.
• Carbon Monoxide & Open Flame: Charcoal produces toxic carbon monoxide. Use only in well-ventilated areas away from flammable objects. Never leave lit charcoals or electric heating heads unattended.

12. Limitation of Liability & Warranty Disclaimer

THE SITE, ITS CONTENTS, AND ALL MERCHANDISE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, B2 HOOKAH™, ITS OFFICERS, DIRECTORS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, INJURY, PROPERTY DAMAGE, OR BUSINESS INTERRUPTION) ARISING OUT OF THE PURCHASE OR USE OF OUR PRODUCTS. IN NO EVENT SHALL B2 HOOKAH’S AGGREGATE LIABILITY EXCEED THE ACTUAL PURCHASE PRICE PAID BY THE CUSTOMER FOR THE SPECIFIC PRODUCT AT ISSUE.

13. Governing Law, Mandatory Arbitration & Class Action Waiver

These Terms shall be governed by and interpreted under the laws of the State of California, United States, without regard to conflict-of-law principles.

• Dispute Resolution & Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or purchases made on B2Hookah.com shall be resolved through confidential, binding arbitration in Los Angeles County, California, administered by the American Arbitration Association (AAA).
• Waiver of Jury Trial & Class Action: You and B2 Hookah™ agree that each party may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any class, collective, or representative proceeding. Both parties explicitly waive any constitutional right to a jury trial.
